TIA Introduces Steps to Decrease Broker Liability

The Transportation Intermediaries Association has taken steps to reduce brokers liability in accident cases. At their annual meeting last month the TIA proposed a few ideas to help its effort. These ideas included a passage by the FMCSA to rate carriers “safe or “unsafe”. Also the TIA has proposed along with the ratings a statement that brokers or shippers using “safe” carriers would not be subject to liability suits.

The TIA has taken such steps due to the recent increase in court cases involving brokers and vicarious liability law suits. Vicarious liability is a broker or shipper being accused of negligent hiring when choosing a carrier and being held liable for the actions of the trucker hired. This issue has become a major concern and the TIA has decided respond.

In addition the TIA will offer assistance in court cases and further educate members in such matters.
